VID refund timetable distinguishes applications from tax returns

Published service times vary by tax and filing trigger. Employer social-contribution refunds are described as taking 15 days on request, subject to how overpayments are allocated.

VID's refund guidance sets out different service times for different taxes, measured from either an application or a declaration.VID The distinction matters when estimating when an overpayment may be returned: the page does not give a single processing period for all refundsVID.

For vehicle operation tax, the stated time is 15 days after receipt of the application.VID For a VAT overpayment, the table gives 30 days after receipt of the declaration.VID For a personal income tax overpayment to a non-resident, it gives 30 days after receipt of the application.VID These entries use different starting documents.

A personal income tax refund following an annual income declaration has a stated period of three months from receipt of that declaration.VID The non-resident VAT refund entry gives a range of four to eight months from receipt of the application.VID Taxpayers should therefore identify the relevant refund type when using the table.

VID's separate social-contributions guidance states that an employer's overpaid mandatory contributions are allocated to other tax debts, if any, or to payments for future periods, or refunded at the employer's request within 15 days. It distinguishes that employer treatment from the State Social Insurance Agency's arrangements for individual overpayments.

The general refund page also addresses mistaken payments exceeding the amounts shown in submitted calculations. VID says those payments are refunded within 30 days of receiving an application if the application arrives within three years of the payment and the taxpayer has no tax debtsVID. That description is separate from the rule referring to refunds under the relevant tax legislation within three years of the statutory payment deadline.

An application concerning a mistaken payment can be submitted in free form through EDS correspondence, using the notification-to-VID category. The guidance also describes securely signed electronic and postal submission. EDS's payments section shows the taxpayer's current position, including unallocated payments, overpayments and debts.

The legal framework is the law “Par nodokļiem un nodevām” and the refund provisions of the relevant tax and social-insurance legislation, with VID's service descriptions identifying the applicable filing trigger and stated time.

Identify the refund type and filing trigger before estimating when an overpayment may be returned.
