Foreign employers posting workers to Luxembourg can now keep the article L. 142-3 document file in EnglishPublic. Guichet's Déclaration de détachement de salariés page requires the retained documents to be drafted or translated in French, German or English

Public.
The file covers the copy of the service contract concluded with the client, contracting authority, subcontractor or their co-contractors, plus any mise à disposition contract; the original or copy of the A1 form or, failing that, proof of the worker's social-security affiliation covering the whole posting; the copy of the employment contract; payslips with proof of payment for the whole posting; time records showing the start, end and duration of daily work; and the copy of the residence permit of any posted third-country national.
The documents are kept for the duration of the posting, on paper or electronically, at the posted worker's workplace or in any place accessible to the designated reference person within the required time, and are produced to the Inspection du travail et des mines or the other competent authorities on request.
The posting itself is declared to the Inspection du travail et des mines through the e-Détachement electronic platform no later than the start of work; no authorisation is issued, and the declaration alone suffices to proceed with the posting. The declaration also names the reference person, designated freely and present in Luxembourg during the service — for example an employee, a fiduciaire or a lawyer — who is the contact for the inspection and the other authorities and assumes no legal liability for the role. Subsequent changes to the reference person, the document storage place or the worker's accommodation are reported to the inspection through the same channel, and a different service requires a new contract.
ITM's own question-and-answer pages on the same document-keeping duty state the French-or-German rulePublic. The underlying article L. 142-3 of the Labour Code, in its current wording, requires the documents to be translated into French or German
