Norway bans Sudan-origin gold trade and gold-mining supplies

From 15 September 2026, no one may directly or indirectly buy, import or transfer gold listed in Annex III that originates in Sudan where it was exported from Sudan to the EU or a third country after the cut-off date.LovdataLovdata The prohibition in Article 1a covers gold under CN 7108 — gold, including gold plated with platinum, unwrought or in semi-manufactured forms, or in powder form — waste and scrap of gold under CN 7112 91, and gold coins under ex CN 7118 90.LovdataLovdataLovdata Because § 2 sixth paragraph of the amending regulation provides that the references to 15 July 2026 in Articles 1a and 1b are to be understood as 15 September 2026, the export cut-off for the gold prohibition reads 15 September 2026 in NorwayLovdata.

Supplying Sudan with the means of gold extraction is prohibited in parallel. Article 1b prohibits directly or indirectly selling, supplying, transferring or exporting goods usable for gold extraction or exploitation of gold resources, listed in Annex IV, to natural or legal persons, entities or bodies in Sudan or for use in Sudan.LovdataLovdata The Annex IV list contains mercury under CN 2805 40 and cyanides and cyanide oxides of sodium under CN 2837 11.LovdataLovdata The prohibition applies whether or not those mining goods originate in the EU.Lovdata

Both prohibitions reach beyond the goods themselves. Technical assistance (faglig bistand), brokering services (formidlingstjenester) and other services linked to the listed goods — and to their delivery, production, maintenance and use — are prohibited where the goods prohibitions apply, as is financing or financial assistance linked to the prohibited transactionsLovdata.LovdataLovdata The regulation defines financing or financial assistance broadly: any act, by whatever method, involving payment or commitment of own money or economic resources, including grants, loans, guarantees, bonds, letters of credit, supplier and buyer credits, import or export advances, and all forms of insurance and reinsurance including export credit insurance.Lovdata Payment and payment terms for the agreed price of goods or services in accordance with normal business practice do not constitute financing or financial assistance.Lovdata

Two carve-outs remain. The gold prohibitions do not apply to gold necessary for the official purposes of foreign missions or international organisations in Sudan enjoying immunity under international law.Lovdata The mining-goods prohibitions do not apply, as relevant, to goods intended for humanitarian purposes, public-health emergencies, the urgent prevention or mitigation of an event likely to have serious and significant consequences for human health and safety or the environment, or response to natural disastersLovdata — and this exception applies without prejudice to authorisation requirements under Regulation (EU) 2021/821Lovdata.

One contract transition exists, and it is narrow. For goods under CN 2837 11 only, the prohibitions do not apply to performance by the transition date of contracts concluded before the cut-off date, or associated contracts necessary for their performanceLovdata — again without prejudice to Regulation (EU) 2021/821 authorisation requirementsLovdata. Because the Norwegian adaptation reads the 16 January 2027 reference in Article 1b as 16 March 2027 and the 15 July 2026 references as 15 September 2026, the transition in Norway permits performance by 16 March 2027 of contracts concluded before 15 September 2026Lovdata. The regulation was adopted by the Ministry of Foreign Affairs (Utenriksdepartementet) on 1 September 2026, published on 2 September 2026 and enters into force on 15 September 2026Lovdata, amending the 2006 Sudan sanctions regulationLovdata.
