Employers must report no-show seasonal workers in 7 days

Employers hiring foreign nationals for seasonal work must report a no-show foreignerE TAR and ask for the work permit to be cancelledE TAR. Order No. A1-557 of 10 September 2026 amends the 4 September 2026 order No. A1-533E TAR, which itself amends the 2017 order No. A1-253 approving the procedure for issuing seasonal-work permits to foreigners and the seasonal-works list, by adding a new point 35(1) to Chapter VII of the procedure.

Under the new point, an employer informs the Employment Service (Užimtumo tarnyba) through UŽTISE TAR within 7 calendar days of the visa issue dateE TAR about a foreigner who did not arrive or was not hiredE TAR, giving the foreigner's name, surname, date of birth, and the issued permit's date and number, and requests cancellation of the work permitE TAR.

The rule sits inside the procedure implementing Article 62(1) of the Įstatymas dėl užsieniečių teisinės padėties and Directive 2014/36/EU on third-country seasonal workers: one foreigner holds one permit at a time, permits for up to 90 calendar days require a Schengen visa where no visa-free regime applies, longer ones a national visa, and the permit is issued and cancelled, its validity extended and duplicates issued by the Employment Service (Užimtumo tarnyba), with a Government-set state fee for issue, duplicate and extension. Employers intending to hire a foreigner for seasonal work under a fixed-term contract apply to the Employment Service where the vacancy was registered, with documents still submittable one month after the vacancy notice expires. The file comprises the application form with the foreigner's travel-document copy, the fixed-term contract stating workplace, seasonal-activity type, duration, wage, weekly hours, paid-leave length and expected start, qualification proof where required, and suitable-housing evidence: at least 7 square metres per adult declaring residence there, shown by Real Property Register extracts, registered lease or use contracts, or a person's undertaking to provide housing, with employer-provided housing proven by a registered lease meeting the Article 62(1)(1)(4) conditions. Copies need the manager's signature and seal where a seal is required.
