ARQUUS sets weather-stoppage recovery and CETI transfer rules

The amendment adds lost-hours recovery after collective stoppages, including orange-alert weather, and lets staff move CETI days to the RCR counter.

La société ARQUUS, société par actions simplifiée, and three organisations ("L’Organisation Syndicale CFDT", "L’Organisation Syndicale CFE-CGC", "L’Organisation Syndicale CGT") concluded an amending agreement ("Le présent avenant est conclu ENTRE"), done at Versailles in seven original copies on 9 July 2026Legifrance ("Fait à Versailles en 7 exemplaires originaux, le 9 juillet 2026") to the company working-time agreement of 28 March 2025, in force since 1 January 2026. The amendment states it "entrera en vigueur le 1er septembre 2026Legifrance" and "est conclu pour la durée de l’accord collectif qu’il modifie".

Its first part creates a new article on recovering hours lost to a collective work stoppageLegifrance, under article L. 3121-50 of the Labour Code. Recovery can follow accidental causes such as a power cut, a major IT failure, a water-supply break or a technical incident stopping activity temporarily, bad weather including an orange or red weather alert that makes work or travel dangerous or impossible, or an exceptional climate episode such as snow, ice, flooding, storm or extreme heatwave leading the company to stop activity collectively, or force majeure.Legifrance Recovery is also available after an inventory ("La réalisation d'un inventaire") or a shutdown ("Le chômage") of one or two working days between a public holiday and a weekly rest day, or of a day before annual leave. The employer informs the labour inspector under the conditions of article R. 3121-33 of the Labour Code.

Lost hours can be recovered collectively or by rotation.Legifrance The employer sets the distribution of recovery hours within the statutory and contractual limits on maximum working time and rest, and within the ceilings of the underlying agreement. Recovery hours are working hours, excluding periods treated as effective working time, moved for one of the listed causes; monthly-paid staff receive the pay that would have been due had they not been moved. For staff on a multi-week cycle, recovery takes mainly the form of full days on days the cycle normally leaves unworked, excluding Saturdays, Sundays and public holidays except by special agreement or exceptional service need.

Hours lost in the cases of article L. 3121-50 are recoverable within the twelve months before, or until the end of the calendar year following, their loss.Legifrance

The second part widens the individual time-savings account (CETI).Legifrance Each employee may request, once per calendar year, the transfer of one or two days from the CETI to the replacement compensatory rest (RCR) counterLegifrance. Transferred days are converted into hours at the employee's individual schedule on the request date, debited from the CETI and credited to the RCR counter, then used under RCR rules — more flexibility for short absences than the current days-or-half-days format.

The amendment states the other provisions of the initial agreement not covered remain in force ("Les autres dispositions de l’accord collectif initial, non visées par le présent avenant de révision, restent en vigueur"), may be revised at any time by amendment ("pourra être révisé à tout moment pendant la période d’application, par le biais d’un avenant"), and is filed on the ministry of labour teleprocedure platform and with the registry of the Conseil de Prud’hommes de Versailles ("le présent accord est déposé sur la plateforme de téléprocédure du ministère du travail et du greffe du Conseil de Prud’hommes de Versailles"), with notice to each representative union organisation and information to the branch joint committee.

Legal basis: the rules rest on the Avenant de révision à l'accord d'entreprise portant organisation du temps de travail n°2, applying articles L. 3121-50, R. 3121-33 and L. 2232-12 of the code du travail.
