Timac Agro unifies maintenance on-call pay and rest rules

"Les établissements des Usines Malouines de la société Timac Agro France" and two unions ("CFDT", "F.O") signed the establishment on-call accordLegifrance, done at Saint-Malo on 6 July 2026 ("Fait à Saint Malo, le 06 juillet 2026")Legifrance. It states that an on-call agreement "a été signé le 24 mai 2012" and that the new accord unifies current regimes ("cet accord vient uniformiser les régimes d’astreinte") for the Quai intérieur plant, the Zone industrielle plant and the PAL/MG plant. It covers all staff except cadres and senior managersLegifrance, replacing all prior on-call agreements and practices in scopeLegifrance. The agreement runs for an indefinite periodLegifrance and takes effect from the signature dateLegifrance.

On-call is defined as a period in which the employee, without being at the workplace or at the permanent and immediate disposal of the employer, must be able to intervene to work for the company. Covered needs include fire-alarm triggering, critical breakdown or maintenance, plant stoppage, a telesurveillance call, a line-manager request, or any other circumstance making intervention indispensable. On-call runs outside normal hours; apart from interventions, staff pursue personal activities but stay reachable near the workplace to reach the site in about one hour. Waiting periods are not effective working timeLegifrance; intervention time is, from starting the necessary operations or leaving home to completing them or returning home, travel includedLegifrance.

The regime covers duly qualified, experienced maintenance staff (coefficient 175 indicative)Legifrance. Assignment and frequency are binding management decisions. Staff 55+ are to be offered an exit where possible, by agreement, without compensation.

Weekly on-call ("Astreintes semaine (y compris samedi-dimanche)") runs Monday 8:00 to Monday 7:59 minus worked periods, on rotations from one week in two to one week in eight. Exceptional formats: a single 24-hour day and a full weekend (Friday 16:00–Monday 8:00). Rosters go out at least three weeks ahead, reducible to one clear day exceptionally; no on-call during leave, JRTT or suspension, and rest rules apply.

Standby gives a flat-rate premium (amounts redacted in the published version), revalued only on signature of a general-increase agreement under article L2242-1, plus a polyvalent premium for covering another plant. Call-out pay ("Une indemnité de déclenchement sera accordée au salarié rappelé") runs at the unenhanced hourly rateLegifrance: "Rappel de jour : 1 heure", night (21:00–6:00) and Sunday or public holiday two hours, and half an hour for a recall while still on site. Intervention hours between 21:00 and 6:00 and on Sundays and public holidays carry "une majoration de 100%" for on-call staff whose normal hours exclude such workLegifrance, not stacked with overtime upliftsLegifrance.

Under article L. 3131-2, daily rest of eleven hours may drop to nine for staff who interveneLegifrance, never below nineLegifrance and never beyond maximum working-time limits; the two missing hours join a later rest period over eleven hours. Return-to-work depends on timing: home before 1:00 means resuming no earlier than nine hours after the return; no return before 1:00 gives the scheduled morning off with maintained pay ("tout en bénéficiant du maintien de sa rémunération sur cette période"); a call-out more than nine hours after the working day leaves the normal day intact ("le salarié est réputé avoir bénéficié d’un repos quotidien suffisant"). Staff notify their manager by text or email, and interventions are rounded up to the quarter hour.
