CERCLE D'OC, a Toulouse association under the loi du 1er juillet 1901, adopted a collective accord on working time by two-thirds staff referendum under article L.2232-21 du Code du travail. Concluded for an indefinite period with effect from 1 October 2026 subject to filing on the labour ministry platform and at the greffe du Conseil de prud'hommes de Toulouse, it covers the whole association and aims to reconcile operational needs with autonomy for staff — notably cadres whose roles prevent them following collective hours.
The core is a forfait annuel en jours of 218 daysLegifrance, journée de solidarité included, over a 1 January–31 December reference year, for autonomous cadres not following collective hours and for any staff whose hours cannot be predetermined with real autonomy — eligibility judged on actual duties, with each convention requiring the employee's written agreement. Extra paid leave reduces the 218-day reference; reduced-day forfaits are available with the employer's express consent but are not part-time. Rest days are announced each January under the formula year-days minus 218 minus weekends minus holidays minus leave — 10 days in the worked 2026 example (365 − 218 − 104 − 25 − 8) — taken whole or half at the employee's choice with hierarchy agreement, on 15 days' notice, non-carryable, postponable in emergencies. Renouncing rest days is paid at +10% under article L.3121-59
Legifrance. Forfait staff escape the daily and weekly maximums and the statutory week (articles L.3121-18, L.3121-20, L.3121-22, L.3121-27) per article L.3121-62, but keep mandatory rest; pay is a flat forfait shown on the payslip; arrivals and departures are prorated over calendar days with half-day rounding up; absences deduct from the forfait at a day-value derived from gross annual pay over forfait days plus leave, holidays and rest days, with no make-up. Workload is tracked in an individual log, a yearly interview under articles L.3121-60 and L.3121-65 covers load, amplitude, rest, work-life balance and pay, a 7-working-day meeting follows any load alert, and an optional separate medical visit guards health.
Disconnection applies to allLegifrance: no duty to read or answer work messages during daily or weekly rest, rest days, leave or any suspension, except exceptional situations or objectively justified service need
Legifrance — 20h–8h is the preferred window for day workers
Legifrance, inapplicable to staff habitually working those hours, who disconnect during their actual rest; no adverse measure may follow silence.
Night work (21h–6h)Legifrance stays exceptional, justified by service continuity. A night worker means 3+ night hours at least twice a week on the usual schedule, or 270+ night hours over 12 consecutive months. Daily night work caps at 8 hours and the 12-week average at 40 hours; night workers earn compensatory rest of 20% of hours worked between 21h and 6h
Legifrance, takeable by the hour, half- or full-day within 6 months at unchanged pay — forfait staff's night hours counting only for this right and night-work compliance. The accord adds health safeguards, transport and childcare attention, priority for day posts, 20-minute breaks from 6 hours, and regular occupational-health follow-up.
Legal basis: the accord collectif relatif à la durée du travail of CERCLE D'OC, adopted by staff referendum under article L.2232-21 du Code du travail, applying articles L.3121-1, L.3121-58, L.3121-59, L.3121-60, L.3121-62, L.3121-65 and L.3122-1 et suivants for night work, with filing under article D.2231-2.
Sign written forfait conventions with eligible autonomous staff, announce January rest-day counts, and schedule night shifts within the 8-hour daily and 40-hour average caps with 20% compensatory rest.
