It applies to all employees on open-ended or fixed-term contracts whatever their working time. Workers temporarily present who remain employed by their original employer — subcontractor staff or staff seconded in France from another Froneri group entity — and employees on work-study training contracts (apprentissage or professionnalisation) are excluded.
There are two kinds of on-call duty. Weekend on-call covers, for information, the stretch from Saturday end of production to Monday restart of production. Weekday on-call covers, currently and for information, Monday to Friday from 17:00 to 05:00 the next day. Anyone placed on call receives a standby premium (prime d'astreinte) for the constraint of being on call, whether or not they are called outLegifrance: €70 gross per day for weekend on-call and €140 gross per week for weekday on-call. The premium is subject to social charges and income tax and is indexed to the general increases for Ouvriers-Employés resulting from the annual pay negotiations.
Time spent actually intervening during on-call periods counts as effective working time and is treated as suchLegifrance. Where an intervention requires going on site, mileage costs are reimbursed on an expense claim. The premium scale itself can be revised during the annual pay negotiations without signing a new amendment. The accord is filed on the Ministry of Labour's teleprocedure platform, with a signed and an anonymised version, plus one copy at the conseil de prud'hommes registry, and is brought to staff by posting or other suitable communication.
