The Société Fromagère de Lons-le-Saunier puts its management staff on compulsory type-2 responsibility and decision on-call dutyLegifrance, replacing any earlier company accord, unilateral decision or usage on the same subject. The accord covers these maintenance and plant jobs: maintenance, new-works, packaging and process maintenance managers, pre-treatment and energy managers and continuous-improvement managers on the maintenance side, and operations, continuous and batch production, packaging workshop, sliced-products workshop, supply chain, scheduling, environment, quality and reception and dispatch managers on the plant side. Other categories can be added later by avenant after consultation of the comité social et économique, and on-call duty is an inherent job requirement rather than a contract change: volunteers are preferred but no one has an acquired right to be on, or off, the rota.
On-call runs from Friday 18:00 to Monday 08:00 and on public holidays. Staff are told their rota at least two months in advance, cut to three clear days in unforeseeable exceptional circumstances, and the on-call compensation appears on the payslip. The rota must be spread evenly, avoiding systematically placing the same person on daily or weekly rest periods, though one person may cover consecutive periods when the scheduled person is absent. During on-call, staff must be reachable at all times and able to intervene promptly, remotely or on site, using company phones and laptops supplied beforehand to those who lack them and returned afterwards.
On-call time itself is not effective working time under article L3121-9 of the Code du travailLegifrance and counts toward minimum daily and weekly rest; only intervention time, including travel, is effective working time, paid as such with any night, Sunday, holiday or overtime uplifts for non-cadres. Remote intervention counts only when directly linked to the on-call purpose and longer than 15 minutes cumulatively over 12 consecutive hours; it starts when the employee begins using the remote tools and ends when that use stops. After each on-call with an intervention, the employee reports duration and hours split between travel and site presence, the reason, who called, the fix applied and any unresolved issues. Travel time between home and the intervention site is measured with the Mappy application, and travel costs are reimbursed or covered by a service vehicle.
Daily rest of 11 consecutive hours and weekly rest of 35 consecutive hours (24 plus 11) must be preserved: anyone intervening must still receive the full rest unless they already had the Code du travail minimum before intervening, and hourly staff cannot exceed 48 hours in a week while day-package staff cannot exceed 214 working days a year including the journée de solidarité. Managers enforce these limits.
