The Livron-sur-Drôme association Val d'Emploi is setting compensatory rest for occasional evening and Saturday work. The accord signed on 24 September 2026 with the staff representatives covers one-off evening events such as markets, catering services, entertainment and stands, and Saturday shop openings staffed by volunteers. It runs indefinitely from 1 October 2026Legifrance and cannot derogate from public-order working-time rules or more favourable branch, contractual or customary provisions.
Only hourly-counted employees who may exceptionally be called on for evening or Saturday assignments are coveredLegifrance. The reference week is 35 hours over five days, Monday to Friday. Every evening or Saturday assignment needs prior management authorisation specifying as far as possible the nature, place, expected hours, employee and recovery terms; hours actually worked are tracked by reliable means, with the 11-hour consecutive daily rest and the applicable weekly rest preserved. Volunteers are preferred and assignments spread evenly, subject to skills and organisation.
Evening hours between 19h00 and 21h00 earn rest equal to time worked plus 15%Legifrance. Hours between 21h00 and 5h00 earn rest plus 25%, subject to the specific night-work rules
Legifrance: night work stays exceptional, and where the legal conditions for night work or night-worker status are met, the statutory guarantees, counterparts and monitoring apply cumulatively or in substitution, whichever is most favourable. Where the hours are overtime, the rest compensation stands in for payment and uplift as equivalent compensatory rest, within the legal limits; Saturday rest does not affect any mandatory compensatory rest owed beyond the annual contingent.
Saturday hours earn rest equal to time worked plus 15%Legifrance. Saturday staffing is capped: two Saturdays a month for full-time staff, one for staff above 20 contractual hours a week without being full-time, five hours on one Saturday for staff at or below 20 hours a week; employees on therapeutic part-time cannot work Saturdays at all. Scheduling must preserve rest regularity and work-life balance as far as possible.
Rest rights are counted precisely, notified through the working-time tracking system, and normally taken within three months of accrual on a date agreed jointly or set by management with reasonable notice; leave, sickness, maternity, paternity, adoption, work accidents and other suspensive events give the legally required carry-overs. The counterparts do not stack for the same hours with any other counterpart pursuing the same purpose, cannot strip a public-order minimum, and cannot be waived in advance; counting disputes refer first to the association's tracking records. Health and safety cover atypical hours, excessive spans and fatigue, with a periodic implementation review to staff representatives. The accord is revisable at any time, terminable on at least three months' written notice with meetings on the consequences, and subject to the filing, publication and communication formalities for collective accords, including an anonymised publication version.
