Employers that post workers to Estonia while operating in retail or wholesale trade (jae- ja hulgikaubandus) or in finance and insurance (finants- ja kindlustustegevus) no longer have to file posting data with the TööinspektsioonRiigiteataja
Riigiteataja. Amended § 51(1) of the Eestisse lähetatud töötajate töötingimuste seadus carves those two sectors out of the advance-filing duty
Riigiteataja; every other posting employer files as before
Riigiteataja.
The duty that falls away is a detailed one. The § 51(1) filing names the posting employer and its contact person, the posted workers with identity numbers or birth dates and document numbers, the planned start and end dates, the Estonian client or host and its contact person, and the sector the worker will work in with the workplace address — submitted in a form permitting written reproduction before the worker starts work in Estonia, with changes notified before they take effect. The exemption covers an employer operating in retail or wholesale trade or in finance or insuranceRiigiteataja.
What does not change matters as much. The Inspectorate may still demand the underlying documents — employment contract, A1 certificate, schedule, pay records or equivalents — for immediate productionTI, and up to three years after the posting ends (§ 51(3)–(5)). Driver posting declarations through the internal-market information system (§ 51(1¹)) are untouched
Riigiteataja, since the exemption reaches only the § 51(1) data set
Riigiteataja. And the duplication rule in § 51(7) still excuses any employer that already filed the same data with the Politsei- ja Piirivalveamet under the Aliens Act.
The second change runs the other way. Where the Inspectorate previously could obtain only the § 51(1) data set on a posted worker from the Police and Border Guard BoardRiigiteataja, amended § 51(8) adds citizenship data (kodakondsuse andmed)
Riigiteataja to what it may pull
Riigiteataja. Legal basis: Eestisse lähetatud töötajate töötingimuste seadus § 51 muudetud kujul.
If you post workers to Estonia while operating in retail, wholesale, finance or insurance, stop filing §51(1) posting data and keep the on-demand documents ready instead.
