A company filing the Jersey corporate tax return must declare where it is resident for tax purposes, a question separate from where it is incorporated. A company is tax resident in Jersey if it meets Article 123(1)(a) or Article 123(1)(b) of the Income Tax (Jersey) Law 1961. In outline, a Jersey-incorporated company is regarded as Jersey resident unless its business is centrally managed and controlled outside Jersey in a country or territory where the highest company tax rate is 10% or higher and it is tax resident there; a company incorporated outside Jersey is regarded as Jersey resident if its business is managed and controlled in Jersey. A Jersey-incorporated company that is not Jersey tax resident must supply suitable residence evidence such as a Certificate of Tax Residence, with copies attached in section 9.
Where a company moves its place of central management and control from Jersey to another jurisdiction during the year and becomes tax resident in that other jurisdiction as well, the return position for that year is now spelled out.GOV The company should declare that it is a Jersey resident for that year.
GOV It should declare income, profits and gains after taking into account the terms of any applicable double tax agreement, which means declaring only income, profits and gains to the extent Jersey retains taxing rights over that income after the company becomes resident elsewhere.
GOV It should also provide the economic substance information for the period until it became resident in the other jurisdiction.
GOV
The practical effect is a three-part filing: residence answered Jersey for the move yearGOV, quantum cut to Jersey's surviving taxing rights under the treaty
GOV, and substance coverage stopped at the move date rather than the full year
GOV. Other unincorporated bodies and associations remain tax resident if managed and controlled in Jersey, and further detail on non-resident reporting sits in the reporting-requirements guidance for non-Jersey resident companies.
The residence answer drives the next question. Question 1a, which appears only when the Q1 residence is not Jersey, asks whether the entity trades in Jersey through a branch or permanent establishment. Article 3 treats a branch, factory, shop, workshop, quarry, building site or place of management of the company as a permanent establishment of a company, while other entities have one where they have a fixed place of business including a building site or construction project. An entity with a Jersey permanent establishment answers yes; without one, no.
Section 1 then moves through status, accounting and filing mechanics that frame the residence declaration. Question 2 requires each applicable corporate status, from foundations and financial services companies to pension companies, 0% companies, funds, large corporate retailers, hydrocarbon trades, charities, intermediary service vehicles, utility companies and cannabis-industry companies. Question 2a turns on whether an accounting date ends in the year of assessment, with Jersey-resident companies required to prepare accounts including dormant companies. Questions 3 and 3a require Jersey-resident filers, and branch or permanent-establishment filers, to file signed financial accounts or statements and attach a PDF in section 9 before advancing past Section 1.
The charge rests on the Income Tax (Jersey) Law 1961 residence and charge rules in Articles 123, 123C and 123D, double tax agreements limiting Jersey's taxing rights after a move, and the Taxation (Companies - Economic Substance) (Jersey) Law 2019 for the substance period.
If central management moves out of Jersey mid-year, still answer Jersey resident for that year, restrict declared income to Jersey taxing rights under the treaty, and file substance information to the move date.
