Long-service pension law and guidance give different start dates
The special-pension guidance describes a nine-month application window, but applicants must check their scheme’s start-date rule before relying on retrospective payment.

Section 7 of Väljateenitud aastate pensionide seadus states that its long-service pension is awarded from the application date.Riigiteataja The Social Insurance Board’s special-pension guidance instead describes a broader filing window for receiving pension from the day entitlement arises. Applicants considering filing after entitlement need to distinguish that guidance from the statutory rule for their pension.
The guidance tells special-pension applicants to submit an application during a nine-month period: from six months before entitlement arises until three months afterwards.Sotsiaalkindlustusamet It presents this as the timing needed to receive pension from the entitlement date. However, the Board’s general application guidance associates that window with old-age pension and says other pension types are awarded from the application date. Applicants and advisers therefore need to identify the particular pension scheme before relying on the broader wording.
For pensions under Väljateenitud aastate pensionide seadus, the statutory rule is explicit: “Väljateenitud aastate pension määratakse pensionitaotluse esitamise päevast.” The Act also applies the state pension insurance legislation subject to its own special rules. The special-pension guidance’s filing window should therefore not be treated as a blanket promise of retrospective payment for every pension described there.
The Board also sets out how to lodge a special-pension application. An application can be submitted through the communications section of the self-service portal or by digitally signed email. It can also be posted to Paldiski mnt 80, 15092 Tallinn, or submitted at a customer-service office. Pension counselling can be booked through self-service, and an application can also be submitted during that meeting.
An applicant attending customer service should bring an identity document. The accepted examples include an ID card, driving licence or Estonian citizen’s passport. For a foreign citizen, the Board checks the population register for the existence and validity of a residence permit or right of residence.
Submit the documents needed to calculate the pension with the application. The Board’s supporting-document guidance asks for pensionable-service evidence, such as a work record book or other employment records, and the account number for payment. Paper evidence must be original or a notarised copy; electronic images must be legible, show all information and include every page with entries, in colour where the original is coloured.
The relevant statutory provisions are §§ 7 and 11 of Väljateenitud aastate pensionide seadus and §§ 31–32 of Riikliku pensionikindlustuse seadus.
Check your pension scheme’s statutory start-date rule and confirm it with the Board before delaying an application.
