Albioma thermal branch sets single CSE rulebook and budgets

The works councils (CSE) of Albioma's French thermal branch get a single rulebook: six meetings a year, one preparation day per meeting outside delegation hours, capped consultation deadlines with negative opinions by default, and fixed operating and social-works budgets, under an inter-company accord signed in Paris on 6 February 2026Legifrance.

The accord applies in each company of the branche thermique France: currently the UES du Thermique Réunionnais, Albioma Galion and Albioma Le MouleLegifrance. Each company keeps its own CSE as a single establishment; absorbing another entity does not create a separate establishment. It runs for an indefinite term from the day after filing, and interpretation disputes go to a joint commission meeting within 15 days of a request, whose signed minutes bind the parties while neither side starts litigation over the dispute until the interpretation period ends.

Each CSE meets six times a year, at least four meetings covering health, safety and working conditions in whole or part. Alternates attend only in place of absent full members but receive invitations and documents for information. The agenda and documents go out by email at least 3 days (72 hours) before the meeting, with the same deadline applying to the labour inspector and social-security prevention officers. Before each of the six annual meetings, full members get one preparation day that does not count against delegation hours, scheduled ahead and never carried over if unused; extraordinary meetings carry no automatic preparation time, though the chair and secretary may jointly grant up to 4 extra hours where the matter needs heavy analysis.

Full members use the statutory delegation-hour quota with notice to HR and line managers; urgent departures may be announced to a nearby colleague or by voicemail, but that must stay the exception. Forfait-days managers count delegation time in half-days of four hours deducted from the annual day count. The CSE secretary gets an extra individual 5 hours a month, carryable over the calendar year. Hours may be pooled across full members and alternates monthly and carried over up to 12 months, never giving anyone more than twice a full member's monthly quota. Minutes are drawn up within 15 days, approved at the next meeting and posted; in-person meetings are the rule, with videoconference only exceptionally.

Consultation deadlines are one month from the employer providing the information (or posting it in the BDESE), extended to the day after the next meeting where the employer waits for it, and two months where an expert is appointed; past the deadline the CSE is deemed consulted with a negative opinion. Recurrent consultations run every two years on strategic orientations and yearly on the economic and financial situation and on social policy, working conditions and employment, fed by the BDESE. Expert examinations across all recurrent consultations are capped at one a year — at most four per four-year term besides an economic-alert examination.

The operating budget is 0.30% of gross payroll within the meaning of article L. 2312-83, conventionally increased by 20% for the communauté de travail, plus up to EUR 1,500 per full member for IT equipment over the four-year term on paid invoice; the social and cultural works budget is 1.4% of the same increased base. Newly elected members get a combined five-day induction course, renewable each term, with the employer covering travel and accommodation. The accord is filed on TéléAccords and with the Nanterre conseil de prud'hommes and is to be published in the national database.
