EU raises Malaysia ferro-manganese duty-free quota retroactively

The European Commission has corrected the safeguard tariff-rate quota for ferro-manganese (CN codes 7202 11 and 7202 19) originating in Malaysia.Europa The 2022 import figure used to size Malaysia's quota was 581 tonnes
Europa; the correct figure is 41,279.3 tonnes
Europa. Nearly 40,700 tonnes of 2022 ferro-manganese imports from Malaysia had been declared confidential in the publicly available Eurostat statistics
Europa and were missing from the calculation
Europa. Because in-quota volumes are set 25% below the average of 2022-2024 imports
Europa, the error understated Malaysia's quota
Europa, and the Commission has recalculated it upward
Europa.
Under order number 09.8819, the quarterly in-quota volumes for Malaysia are now 9,330.47 net tonnes for 18 November 2025 to 17 February 2026Europa, 9,026.21 net tonnes for 18 February to 17 May 2026
Europa, and 9,330.47 net tonnes for each of the two quarters to 17 November 2026
Europa. The annexed table continues the quarterly schedule through the second and third years of the measure to 17 November 2028, with the 0.1% annual liberalisation the safeguard provides for.
The correction applies from 18 November 2025Europa, the date the underlying safeguard took effect
Europa. Malaysian ferro-manganese entries released since that date that paid the out-of-quota charge but fall inside the enlarged quota were overcharged
Europa: amounts of import duty overcharged are repayable under Article 116 of Regulation (EU) No 952/2013 laying down the Union Customs Code
Europa, so importers and their customs brokers should apply to the customs authorities for repayment of the excess duty. Within the quota, imports enter without the safeguard charge.
Europa Once a quarterly quota is exhausted, the variable duty is the difference between the 1,316 EUR-per-tonne price threshold and the net free-at-Union-frontier price before duty, and no duty is due where the frontier price reaches the threshold. Drawings on each quarterly quota stop on the twentieth working day after the quarter ends, and unused balances do not carry forward to the next quarter.
The safeguard runs for three years to 17 November 2028, and Malaysia is among the developing countries subject to the measure for ferro-manganese. The correction is made by Commission Implementing Regulation (EU) 2026/2270 of 15 October 2026Europa, Article 1 replacing part of the Malaysia quota table in Annex III to Implementing Regulation (EU) 2025/2351
Europa and Article 2 fixing retroactive application from 18 November 2025
Europa, adopted under Article 16 of Regulation (EU) 2015/478 and Article 13 of Regulation (EU) 2015/755.
