Complaints fall into two groups: the assessed local levy for municipal and non-municipal household waste management and the application of levy relief; and the quality of the waste management service and the organisation of its provision. Only written complaints are examinedE TAR. They may be filed through the E. pristatymas system, by other electronic means, by post or in person. A complaint filed by electronic means must carry a qualified electronic signature, except when filed through E. pristatymas. Oral approaches count as consultations and do not open proceedings.
A complaint must be in the state language or carry a translation, must respect etiquette and good morals, and must be signed by the complainant or a representative. It must name the body and the complainant with contacts, the contested act, omission or decision with its date, the demand, the supporting facts and reasons, known parallel court proceedings, annexes, and the drafting date and place. The contested decision and supporting documents must be annexed, though the complainant need not supply information the deciding body can obtain from other authorities. A representative must attach a power of attorney or equivalent. Anonymous complaints are not examined unless the executive institution, its authorised person or the administrator finds the information significant for the public interest or environmental protection.
A complaint against an act or decision is filed within one monthE TAR of the day the person learned or should have learned of it
E TAR. A complaint about inaction or delay is filed within two months of expiry of the statutory or otherwise applicable deadline for the omitted act
E TAR. Missed for an important reason, the deadline may be renewed on a reasoned, evidenced request decided within five working days and filed with the complaint through the same channel.
The administrator examines complaints firstE TAR and decides within twenty working days of receipt
E TAR, counting from the next working day where a complaint arrives after hours or on a rest day or holiday. Where the complainant amends the complaint or adds substantially new demands, time runs from the amended filing. It may be extended by up to ten working days for objective reasons, with written reasons within five working days; where archive or third-party documents are awaited, time runs from their receipt. Defective complaints draw a notice within five working days with at least five working days to cure; unresolved defects may end examination by reasoned decision notified within three working days. Examination never excuses timely payment of the levy, except where payment is suspended by decision.
A complainant disagreeing with the administrator's decision, or receiving none in time, may turn within the same filing deadlines to the mayor of Neringa or the mayor's authorised personE TAR. Further challenge lies with the Lietuvos administracinių ginčų komisija under the pre-trial procedure or with the administrative court
E TAR. Filing a complaint does not suspend enforcement of a decision unless legislation provides otherwise.
