Monaco has rewritten the enforcement of the impôt sur les bénéfices. Ordonnance Souveraine n° 12.211, given on 23 October 2026, amends Ordonnance Souveraine n° 3.152 du 19 mars 1964 instituant un impôt sur les bénéfices, and its provisions apply to the impôt sur les bénéfices for financial years opened from 1 January 2026Gouv.
The inspector of the Direction des Services Fiscaux may now send a demande de renseignements to companies potentially liable for the tax, for each taxation period defined in Articles 6 and 29. The new point 3 added to Article 6 provides that, for companies that are liable, that request counts as a mise en demeure to file the déclaration prévue à l'article 23. An ignored request therefore starts the formal non-compliance clock.
Failure to produce the Article 23 déclaration de résultats within the legal period, or failure to answer the Article 6(3) information request within thirty days, is punished by a flat amende fiscale de 700 euros under the rewritten first paragraph of Article 34.Gouv The previous scale ran from 15 to 75 euros at the director's discretion. The reworked second paragraph also fixes the omission fine at 15 euros, where it previously ran from 1 to 15 euros, updates the cross-reference from 14° to 13°, and rewords the filing occasion.
Late filing of the Article 23 declaration now draws a proportional uplift instead of the old 15-to-75-euro fine. Under rewritten Article 36, the duties charged to the taxpayer, or resulting from a belatedly filed declaration, carry a majoration of 10 % where there was no mise en demeure or where the declaration is filed within thirty days of receiving a mise en demeure to produce it within that period, and of 40 % where the declaration is still not filed within those thirty daysGouv.
The fraud scale is recast in Article 37. The former rule, under which bad faith or fraudulent manoeuvre raised the tax by an amende fiscale of four times its amount, is deleted; omitted or compromised simple duties now carry a majoration of 40 % for mauvaise foi and of 80 % for manœuvre frauduleuseGouv; the criminal-prosecution and administrative-sanction route, taken at the request of the Directeur des Services Fiscaux, is preserved.
Late payment is moved from fines to interest. Rewritten Article 35 provides that default, shortfall or late payment of the acomptes provisionnels or of the assessed balance under Articles 23 and 31, and payment of tax claimed under Articles 25 and 26, give rise to an intérêt de retard owed independently of any sanction. The rate is 0,20 % par mois on the tax charged or deferredGouv, running from the first day of the month after the month in which the tax was due until the last day of the payment month; under Articles 25 and 26 the count stops at the rectification-letter month and restarts after the mise en recouvrement on the same basis. Article 26 extends the reply to a proposed rectification from vingt to trente days, and Article 31 points the over-one-tenth inexact declaration to the intérêt de retard.
Legal basis is Ordonnance Souveraine n° 12.211 du 23 octobre 2026 modifiant l'Ordonnance Souveraine n° 3.152 du 19 mars 1964 instituant un impôt sur les bénéfices, in particular its rewrites of Articles 6, 34, 35, 36 and 37 and its adjustments to Articles 26 and 31, applicable to financial years opened from 1 January 2026.
For financial years opened from 1 January 2026, file the Article 23 return on time, answer any Article 6(3) information request within thirty days, and provision for 0.20% monthly late interest.
