Tuesday 8 December 2026 (jour de l’Immaculée Conception) is a jour férié, chômé et payé for all employees in Monaco, whatever their mode of remunerationGouv. The circular recalls that the day is a public holiday under Loi n° 798 and Loi n° 800 of 18 February 1966, as amended: Loi n° 798 lists the Immaculée-Conception among the jours fériés
Legimonaco, and Article 2 of Loi n° 800 makes those days obligatorily chômés et payés for the whole body of employees regardless of pay mode
Legimonaco.
The holiday is also paid when it coincides with time the employee would not have worked anyway.Gouv Restating the obligations set out in Circulaire of the Direction du Travail n° 79-93 du 13 novembre 1979, published in the Journal de Monaco of 23 November 1979, the circular provides that this jour férié légal is paid even where it falls on the employee's weekly rest day or on a day normally or partially idle in the enterprise
Gouv.
Payment remains conditional on attendance around the holiday.Legimonaco Under Article 5 of Loi n° 800, the holiday payment is due only where the worker duly performed, save for exceptional absence, the working day before and the working day after the holiday as usually worked in the enterprise.
Legimonaco Exceptional absences mean paid leave and duly authorised interruptions for a work accident or occupational illness, any other accident, medically imposed stoppage, the worker's or their child's marriage, the funeral of a spouse, father, mother, child or parent-in-law, and the birth of a child. Cash benefits paid for the holiday day by social-service bodies, insurers or employers during accident or illness interruptions are deducted from the employer's indemnity.
The computation follows Article 6 of Loi n° 800. For employees paid by the hour, day or output, the indemnity equals the wages lost through the stoppage; in the rest-day and idle-day cases it is computed from the hourly wage in force in the enterprise on the date and the average daily working time over the four weeks before the week containing the idle day. For employees paid by the week, fortnight or month, idle days bring no reduction of the period wage; in the rest-day and idle-day cases each such day gives either an indemnity of one-sixth, one-thirteenth or one-twenty-fifth of the weekly, bi-monthly or monthly wage, or a paid compensatory rest determined under the sector's regulatory or collectively agreed provisions. In establishments and services that by the nature of their activity cannot stop work, employees kept on during the idle paid days receive, on top of the worked salary and under Article 7, either an indemnity equal to that salary or a paid compensatory rest.
Legal basis is the Circulaire n° 2026-14 relative au mardi 8 décembre 2026 (jour de l'Immaculée Conception), jour férié légal, applying Loi n° 798 du 18 février 1966 portant fixation des jours fériés légaux and Loi n° 800 du 18 février 1966 régissant la rémunération et les conditions de travail relatives aux jours fériés légaux, with the obligations of Circulaire of the Direction du Travail n° 79-93 du 13 novembre 1979.
Treat Tuesday 8 December 2026 as a closed paid holiday for all staff, and pay it even where it falls on a rest day or an idle day.
