Household employers now pay against the conventional minima scale effective 1 November 2026Service Public. The pay reference for salariés du particulier employeur under the Convention collective nationale des particuliers employeurs et de l'emploi à domicile du 15 mars 2021 is the scale applicable from 1 November 2026
Service Public, replacing the scale that applied from 1 June 2026, with the official source now carried by Legifrance. November payroll for home helps, childminders and carers must be checked against the new floor.
Salary is paid monthly on the date set in the contract, by virement, chèque, titres Cesu préfinancé or espèces, with cash allowed up to €1,500. The employer gives a bulletin de paie except where the salarié is declared through Cesu or Pajemploi, and may use Cesu+ or Pajemploi+ with the salarié's written agreement by mandating those bodies to pay the wage.
Hours above the contractual weekly duration and up to 40 hours a week are paid at the contractual hourly rate; above 40 hours of effective work a week the overtime top-up applies at 25 % for the first eight hours and 50 % beyond, paid monthly or recovered within twelve months as the contract provides, counted from Monday 0h to Sunday 24h. In shared custody arrangements the extra hours count in overall effective working time. Paid-leave indemnity follows the acquired leave: with Cesu declaration below 32 hours a month the hourly wage includes the leave indemnity through a 10 % top-up, and at or above 32 hours it is paid when leave is taken, with monthly integration at 10 % possible by agreement.
Daytime responsible presence counts as two-thirds of an effective hour at the contractual gross hourly rate, moving to full effective hours where the salarié must intervene repeatedly. Night presence is covered by a flat-rate indemnity that rises with the number of interventions: at least one-quarter of the contractual hourly rate for an equivalent effective duration where the salarié steps in once on some nights, at least one-third for two or three interventions, and normal pay for intervention time plus at least one-third for the remaining time at four or more interventions, with all night-presence hours paid as effective hours where every night brings at least four interventions. The top-up differs with the number of interventions, following the scale in this paragraph; the amounts themselves are unchanged. Overnight sick-watch hours are effective working time paid at the contractual gross hourly rate.
Worked public holidays add a 10 % top-up; a holiday not worked on a usually worked day keeps pay where the salarié worked the preceding and following working days or held prior authorised absence, while a holiday on a usually unworked day adds nothing. The 1er mai is a non-worked holiday paid as a usually worked day without any seniority condition, doubled where dependent-care duties justify working it. Benefits in kind count toward the wage due, deducted from net pay at €4.70 per meal and €71 a month for housing, with a higher housing figure possible in the contract where the accommodation warrants it. Public-transport or bike-rental subscriptions are reimbursed, annual, monthly or weekly, single tickets excluded, with full reimbursement in shared custody. Disputes go to the conseil de prud'hommes of the employer's home. Legal basis is the Convention collective nationale des particuliers employeurs et de l'emploi à domicile du 15 mars 2021 (presence at night, overtime, paid leave, holidays, salary) with Code du travail articles L1271-1 to L1271-8, L7221-1, L7221-2 and D1271-1 to D1271-5-1.
