On-call is time when an employee, without being at the employer's permanent disposal, must stay reachable to workLegifrance, with only the call-out counting as effective working time
Legifrance. Travel to and from the site counts inside that time. Pre-scheduled holiday rounds on closed sites that are already in the roster are not on-call and count as effective time from the start.
The purpose is continuous operation: frozen bakery and pastry production, storage and conservation, plus energy and refrigeration. Continuous sites roster one technical on-call behind the weekend technician and one management on-call for grave incidents. Closed sites roster one technical on-call for fire, intrusion and cold-chain or energy alarms. A continuous site exceptionally closed keeps only the technical on-call. Night on-call covers sites closed at night, and temporary weekday on-call can cover a shutdown or staff gap after informing the works council.
Large sites use maintenance coordinators for technical on-call, widening to all maintenance staff only during absence or vacancies. Small sites use the whole maintenance service. All site management-committee members can take management on-call. No one works more than 20 full weeks per calendar year or per consecutive 12 months without express agreement, counted as 140 days or shifts. Dirigeant-level managers follow the same organisation but stay outside the pay and working-time provisions.
Each site sets an annual rota after informing its works council. Staff learn dates one month ahead, reducible to one clear day in exceptional cases, and receive a monthly statement of days and compensation. Daily rest is 11 consecutive hours and weekly rest 35 consecutive hours, tested only against travel and call-out time.
Cash pay is 40 EUR for a 24-hour weekday or Saturday spellLegifrance, 50 EUR for a Sunday or public-holiday spell
Legifrance, and 90 EUR for a Saturday 00:00 to Sunday 24:00 weekend
Legifrance, with pro-rata adjustment otherwise. The branch floor is five times the minimum garanti, or 21.10 EUR per day at signing
Legifrance, plus 50% on Sundays and holidays. Travel plus call-out time is paid as effective time, with site-agreement overtime uplifts
Legifrance; Sunday, holiday and night call-outs carry 75%, 115% and 25%
Legifrance
Legifrance. The employee chooses pay or time off including uplifts. Home-to-site mileage is reimbursed at the company rate. Day-rate staff accumulate hours: four hours earn a half recovery day and eight a full day.
Staff carry a mobile, stay immediately reachable, and intervene within one hour. Availability alone earns the flat sumLegifrance; site work adds effective-time pay
Legifrance. Remote telephone fixes count as effective time rounded up to the quarter hour, with no travel pay. Declarations go in a form or Myprotime and need line-manager sign-off before payroll.
The agreement runs indefinitely from the day after filing on Télé-Accords and with the Rennes labour-court registryLegifrance, with notice posted for one month. Revision follows article L. 2261-7-1 on registered-letter notice and a joint meeting within one month. Legal basis: Convention collective nationale des activités industrielles de boulangerie et pâtisserie et des professionnels de l'oeuf, Chapter VII and Articles 67 to 70, and Code du travail Articles L3121-9 to L3121-12, R3121-2, R3121-3, L. 2261-7-1, L. 2231-6 and D. 2231-2 ff.
Put maintenance coordinators and site managers on the annual on-call rota with one month's notice and apply the €40/€50/€90 scale plus effective-time pay for call-outs.
