Würth France has authorised exceptional night work at its Erstein and Montélimar logistics platforms by company accord
Legifrance, signed at Erstein on 3 March 2026Legifrance for a fixed term running until 30 September 2027Legifrance. The accord covers logistics and directly linked support activities — maintenance, IT, general services and project managers — for full-time permanent and fixed-term staff whose contracts cover the intervention, plus agency temps for working conditions; part-timers, minors, pregnant or recently returned maternity staff and anyone medically unfit for night hours are excluded.
Night work stays strictly exceptional and unplanned: only a technical operation begun in the daytime or evening that must continue past 9 p.m. for unforeseeable reasons qualifies — project phases and tests that overrun, or major breakdowns of automated handling, servers, networks, refrigeration or security systems that must be fixed before the next working day. Running order preparation at night is expressly excludedLegifrance. The trigger sits with logistics management no later than 8 p.m.Legifrance, with immediate notice to service managers, staff representatives on site and HR; any night intervention outside that procedure is non-compliant, and staff are informed by any means as soon as the decision is taken.
Staying on past 9 p.m. is voluntary: the line manager calls for volunteers among the teams present, written consent is collected, reasonable time is left for personal rearrangement, and refusing is neither misconduct nor grounds for dismissalLegifrance. The night stint adds to the day shift within hard ceilings — 10 hours a day, exceptionally 12 hours only when stopping would jeopardise restart or system stability the next working day, 43 hours a week — and nobody works past 11.30 p.m.Legifrance Frequency and volume are capped so no one crosses the night-worker thresholds (3 night hours twice a week on the usual schedule, or 270 hours over 12 consecutive monthsLegifrance): expressly, nobody gains night-worker status under the accord.
Annualised staff earn 25% on the half hour between 8.30 p.m. and 9 p.m. and 30% on effective night hours after 9 p.m.Legifrance, paid the following month; day-rate staff receive a flat bonus of 25% of the gross daily rate. Health protection includes prior consultation of the occupational doctor, integration into the single risk-assessment document with CSE-C consultation, an SST first-aider and a fire-safety trained person on site where possible, and an on-request medical visit for any volunteer doubting fitness. Each intervention is logged in the time-management software under a designated supervisor, and a union review of volumes, motives and health data is due by 30 November 2026.

Trigger night work only after a written call for volunteers before 8 p.m., and check individual counters so nobody crosses the night-worker thresholds.
