Estonia adds building-right proof to aquaculture aid files
Aquaculture investment applications must now attach the building-right contract where the applicant farms on building-right land not shown in the land register.

Applications for investment support for aquaculture under the 2021–2027 European Maritime, Fisheries and Aquaculture Fund programme must now include one more document: the building-right establishment contract (hoonestusõiguse seadmise leping) where the applicant uses the land under a building on the basis of a building right (hoonestusõigus) and that right is not apparent from the land register.Riigiteataja The new item 101) joins the supporting documents listed in § 7(3) of the regulation.

The duty closes a proof gap. The regulation already requires that, where a building is constructed, the building and the land beneath it be owned by the applicant or burdened with a building right in the applicant's favour for at least three years from PRIA's payment of the last support instalment, and that a building or immovable housing acquired equipment stay in the applicant's direct possession for the same period. Until now, however, no listed document evidenced the building right itself where the land register does not show it; applicants relying on such a right had no specified instrument to file. The surrounding terms are unchanged. Support goes to marine fish-farm establishment or expansion, freshwater farm modernisation, renewable-energy adoption, and logistics and supply-chain improvement, in the form of reimbursement of actually incurred eligible costs under Article 53(1)(a) of Regulation (EU) 2021/1060, with unit-cost reimbursement for solar equipment. The maximum rate is 50 per cent of eligible costs, or 75 per cent for producer organisations carrying out marine establishment, modernisation or logistics activities; per-round ceilings per applicant run from 400,000 euro for renewable-energy projects to 2,000,000 euro for marine establishment, capped additionally by equity and turnover figures. Costs are eligible from the application date, except preparatory work, which must be finished and paid before applying. Applications are filed electronically through the PRIA e-service within the announced window, and PRIA suspends intake for an activity once its budget is exhausted.
Applicants preparing a file on land they do not own should check the land-register extract first: where the building right is visible there, nothing changes; where it is not, the establishment contract must be attached.
