Offshore asbestos work now needs Arbeidstilsynet permission

The permission requirement covers handling asbestos-containing material that involves a risk of exposure to asbestos dust, including work where asbestos-containing material is only suspected. Arbeidstilsynet issues four kinds of permission: for simpler asbestos work, for outdoor work on water and sewage pipes containing asbestos, for outdoor asbestos work, and for indoor and outdoor asbestos work. Permissions last up to three years. The application must describe how the work will be organised, which methods will be used, which protective measures will be taken and the workers' training, with individual course certificates enclosed. It must include an employer declaration that a doctor has found the worker fit for asbestos work, the undertaking's experience of such work, and the instruction required by § 4-15 covering the type of work applied for. Before the application goes to Arbeidstilsynet, the safety representative, the working environment committee and the occupational health service must be given the application for comment.
Outside the exempted operations, an employer holding a § 4-4 permission must notify Arbeidstilsynet of work with asbestos or asbestos-containing material in good time and no later than one week before the work starts, using the form set by Direktoratet for arbeidstilsynet. The notification must identify the workplace location, the types and quantities of asbestos, the activities and methods, the affected workers with course certificates and the date of their latest health examination under § 4-21, the start date and duration, and the measures taken to limit exposure including the equipment to be used. Workers and their representatives must have access to the notification, and a new notification is due when changed working conditions are likely to increase dust exposure materially. For offshore petroleum operations and the listed land facilities, this per-job notification no longer applies, while the underlying permission requirement now does.
The swap affects petroleumsvirksomhet til havs and operations at the land facilities defined in rammeforskriften § 6, which names the petroleum plants at Kårstø, Sture, Kollsnes, Mongstad, Tjeldbergodden, Melkøya and Nyhamna with associated pipeline systems. Other asbestos duties are untouched: the main rule in § 4-5 that asbestos-containing material must as a rule be removed, the cumulative conditions for repair by encapsulation or sealing, and the ban on embedding asbestos-containing material continue to apply, as § 4-5 is not among the exempted provisions.
