An employer ending employment in Estonia must record two facts in the Töötamise register: the date employment endedEmta and the basis on which it ended
Emta. An entry with only one of them is incomplete.
Emta The date is the day work under an employment contract stopped, the day a võlaõiguslik leping ended, the day of release from public service, or the day a person's tax liability moved to another state.
Emta
When the employer is dissolved or the employee dies, the employer does not file the closure.Emta Employment is then closed automatically
Emta on the basis of äriregister or rahvastikuregister data
Emta. Entries in the register are made against those official registers, alongside the agreement between the parties, court decisions and tax decisions, so a dissolution or death recorded there closes the employment without a separate filing
Emta.
A fixed-term entry is turned into an indefinite one inside e-MTA by opening the registered employment, choosing Muuda, deleting the end date and removing the termination basis by selecting Vali lõpetamise alus, then confirming with Kinnita. When details of employment change, the register currently offers no field for the moment the agreed change takes effect, so the change is recorded without a separate effective date.
The recorded basis must reflect the real reason for the endingEmta because register data decides social guarantees. Where an employer ended a contract under Töölepingu seadus § 85 lõige 4, that detailed provision is not offered as a basis in the register
Emta; the entry uses TLS § 85 lõige 1
Emta. The distinction matters only for Eesti Töötukassa decisions on unemployment insurance benefits and carries no substantive legal difference in outcome.
Responsibility for correctness sits with the person who made the entryRiigiteataja, and a mistake must be corrected without delay
Riigiteataja. A faulty entry can be corrected electronically by the work enabler
Riigiteataja within three months from the start, suspension or termination date
Emta. After three months a correction needs a reasoned request to the responsible processor with evidence
Riigiteataja, filed within 14 days after the need to amend became known
Riigiteataja, and the processor decides within 30 days
Riigiteataja. A correction may be refused when it is not justified.
The duty to register sits with the work enablerRiigiteataja, covering start, suspension, termination and type of employment
Riigiteataja. Starting work is registered no later than the moment work starts
Riigiteataja; suspension and termination are registered within ten days after the suspension or termination day
Riigiteataja. If registration is missed, Maksu- ja Tolliamet or Tööinspektsioon can set an additional deadline with a warning, and continued failure can bring a sunniraha of up to 3,300 euro in total, no more than 1,300 euro the first time and 2,000 euro the second time. Töötukassa takes data for unemployment insurance стаж from the register for employments that started on or after 1 July 2014
Emta, so for earlier periods an employee may still need to present a document proving the relationship
Emta.
Legal basis: Maksukorralduse seadus §§ 251, 252 and 255–258 together with Töölepingu seadus § 85 lõige 1Emta, entered in the register also where the contract was ended under § 85 lõige 4
Emta.
When ending employment, enter both the end date and the matching termination basis in the Töötamise register within ten days and correct any error without delay.
