Lovdata. A skilled worker means a worker holding a publicly approved trade or journeyman certificate or equivalent competence formally equated with such a certificate in the field performed. The rules cover skilled workers and production workers with associated operations, warehouse staff, transport, guards, cleaning and canteens, craftsmen, repair staff, supervisors, controllers, instructors and refrigeration engineers. Employers, and anyone managing such work on the employer's behalf, must ensure the requirements are met.
Workers under 18 years of age must receive at least 80 per cent of the minimum rate in the first paragraph. Workers over 17 years of age who have worked 12 weeks in the company are paid according to the pay group their work belongs to. School-age workers keep accrued pay seniority from one year to the next in the same industry, and seniority accrued as young workers also counts on reaching the age of 18.
Workplaces running shifts add a supplement to the first-paragraph hourly rate: 20 per cent of the § 3 minimum rate for two-shift work and 25 per cent for three-shift work. Allowances paid as reimbursement of expenses actually incurred because of the posting, such as travel, board and lodging, do not count as wages under the regulation.
Apprentices and persons on labour-market measures fall outside the regulation. It also does not apply where the employee is already covered overall by more favourable wage and working conditions under agreement or under the law otherwise governing the employment relationship. Its geographic scope also covers Longyearbyen and Ny-Ålesund on Svalbard.
Legal basis is lov 4. juni 1993 nr. 58 om allmenngjøring av tariffavtaler m.v. (allmenngjøringsloven) § 5, under which Tariffnemnda made Forskrift om delvis allmenngjøring av tariffavtale for fiskeindustribedrifter (FOR-2026-10-22-2236), on the basis of Overenskomst for Fiskeindustribedrifter 2026–2028 between Næringslivets Hovedorganisasjon and Sjømat Norge on one side and Landsorganisasjonen i Norge and Norsk Nærings- og Nytelsesmiddelarbeiderforbund on the other.
Apply at least kr 252,09 per hour for skilled fish-processing work (kr 236,09 for production work) from 6 November 2026, with youth, seniority and shift supplements, including Longyearbyen and Ny-Ålesund.
